Appellate
Pamela Schmidt is a senior attorney in the Milwaukee office of Whyte Hirschboeck Dudek. In 2003, she was named as a "Leader in the Law" by the Wisconsin Law Journal. Ms. Schmidt concentrates her practice in the areas of appellate advocacy, personal injury defense work (particularly relating to product liability as well as the transportation, recreation and entertainment industries) and intellectual property litigation. She has handled more than two dozen appeals, including filing appellate briefs, motions, and petitions to the United States Court of Appeals for the Federal and Seventh Circuits, Wisconsin Supreme Court and Wisconsin Court of Appeals. The cases Ms. Schmidt has handled have involved a wide range of issues including election disputes, denial of disability claims under ERISA, breaches of contract, and personal injury.

Representative Work

  • Represented motorsports organizations before Wisconsin trial and appellate courts successfully enforcing exculpatory contracts and successfully defending against claims of negligence and recklessness.
  • Represented Wisconsin counties in federal and state trial and appellate courts in cases alleging negligence and malfeasance by county employees.
  • Handled appeals of product liability claims on behalf of manufacturers of various products including medical devices and chemicals.
  • Represented insurance companies in federal and state trial and appellate courts in cases claiming that the insurers wrongfully denied coverage or other benefits to their insureds.
