Friday, September 14, 2012

WHD's Karen Tidwall will be a panel presenter for "Development of a National/Regional Model for Managing Litigation" at ALFA International's 2012 Business Litigation Practice Group Seminar on Friday, September 14, 2012.

Panel Description
You work in the Office of the General Counsel for a public company which has been growing rapidly both in terms of revenues and additional offices nationwide. The company has long-standing relationships with law firms for its corporate, securities, and tax work. Like the growth of the company itself, the company’s legal bills also have been growing rapidly as a result of an upsurge in litigation around the country. In the past, the Office of General Counsel has retained the best local firms it could find wherever litigation was filed. However, many of the firms had a steep learning curve regarding the company’s business operations and the specific legal issues facing the company, and the legal bills reflect that learning curve. The Board of Directors has instructed the Office of the General Counsel to reduce the amount of money the company is spending on lawyers, particularly for litigation. In turn, you have been asked to asked to draft a Request for Proposals (“RFP”) to send to a select number of law firms which includes all the criteria necessary to select the right firms, as well as a plan for the company to work closely with the chosen firms to effectively manage the company’s litigation and reduce costs. Likewise, you have been asked to prepare a memorandum regarding how the company should most effectively and appropriately work with the selected firms to achieve the Board’s directive. The draft RFP and plan must be delivered to the General Counsel in one week. Where do you start, and what issues are likely to be of primary concern to you in preparing the draft RFP and the plan?
